Each Tender must bear the hond fide signature of two responsible and approved sureties for the due performance of the Contract, should the Tender be accepted. Persons tendering are warned against writing the names of proposed sureties themselves, as all such Tenders are liable to be rejected. The penalty in each case will be about one-fourth the whole amount that will probably be paid under the Contract. 3. It shall be in the power of either party to limit the duration of the Contract, by giving (in writing) a notice of three calendar months to the opposite party, and to end the Contract at the expiration of that period, — with the exception of Firewood, for which supply six months notice will be required and given. Such notice to be given only on the first day of a month, and within the period for which the Contract is made or agreed to be made. 4. No Transfer of a Contract will be permitted without the previous consent of the undersigned, or (his successor in office. 6. In the event of a Contractor failing to have his supplies ready for inspection and issue at the time and place appointed, the Commissariat Officer to have the power of immediately purchasing the articles reqtiired at his expense, and in the event of such failure or any portion of his supplies being rejected three times during any one calendar month or twelve times during the continuance of the Contract, it shall be optional with the undersigned, or his successor in office, to end the Contract at once, and to enforce the penalty of the bond. 6. Each Contractor will be required to have a Store in Napier, from which Officers and other individuals entitled to Rations, may draw their allowances, aad where each article shall (if required) be open to the inspection of the Commissariat Officer the day previous to its issue. 7. Contractors must be prepared to supply whatever may be demanded by the Commissariat, without reference to the service forwhi^h, the supplies may be required. 8. The Contractor to prepare his own account monthly, according to the prescribed form. Payments will be made as soon as the accounts have beeu examined and returned from Auckland, either in cash or by means of bills upon the Lords Commissioners of Her Majesty's Treasury, at par. at the option of the Commissariat. All Bills for Supplies or Services for the Military Store, Engineer, Barrack, and. Purveyor's Department, must be forwarded to Head- Quarters for the examination and the signature of the Head of the Department, before payment will be made. Each Tender to be in Duplicate, sealed in one Envelope, and endorsed 'Tender for ,' as the case may be. A Tender once sent in cannot be withdrawn or altered. Information as to what Tenders have been accepted, will be given as soon as practicable, and the Bond must then be completed without delay. I, Frederick John Tiffen, Esquire, Returning Officer for the Electoral District of Waimarama, do hereby give notice that by virtue of a Writ bearing date the twenty-second day of November, 1861, issued under the hand of His Honor the Superintendent of the Province of Hawke's Bay, an Election will be held for the return of a qualified person to serage ,as a member of the Provincial Council of Hawlif!jp : Bay for the said Electoral District, and that the nomination of candidates will take place at Waimarama on the 14th day of December, 1861, and that the Poll (if necessary) will be taken on the 19th day of December, 1861, and the state of the Poll declared on the 23rd day of December, 1861.
