QUESTION OF PRIVILEGE
When Service Of Summons on M.P. is Not Valid AN UNUSUAL ACTION COURT’S POWER DOUBTED (By Telegraph—Press Association.) CHRISTCHURCH, Sept. 17. Unusual circumstances were discussed in a traffic prosecution this morning, when Jeremiah Connolly, M.P., was charged under the Waimarai County Council information with overtaking a vehicle at an intersection on July 7, when driving a motor car. A question of privilege arose, as Section 267 of the Legislature Act, 1908, stipulates that service on an M.P. during a session of Parliament shall he invalid, provided the member has not been guilty of felony or misdemeanor.
The problem was overcome through counsel for the defendant pleading guilty. Mr Mosley, S.M., convicted and discharged defendant, stating that he had submitted to a penalty which it was doubtful if the court had power to impose.
