CLAIM ON BANK REJECTED
DISPUTE OVER GUARANTEE. COURT FINDING ON FACTS. (By ToWraph--Proas Association.! WELLINGTON, March 9. After counsel had addressed the Court to-day on the. evidence submitted in the Supreme Court case in which Frederick William Moore is suing tho Commercial Bank of Australia and its Wellington • manager, Edwin Percy Yaldwin, on a charge of misrepresentation, the Chief Justice, Sir Michael delivered his findings of the facts in a full survey of the proceedings. The effect of his (Honour's remarks is that Moore has failed to establish hi# claim against the bank and that Charles Athol PieTard and Sidney John Hammond, against whom Moore is proceeding as co-guarantors oif the account of the Unique Advertising Service Ltd., New Zealand, are not bound by the guarantee they signed. The case has now been adjourned to enable counsel to consider the position as it is affected by his Honour’s findi ugs.
