■WELLINGTON, May 25. Judgment was given in the Supreme Court to-day by Mr. Justice Blair in a divorce action in which, subsequent to the deed of separation being entered into, there was evidence of the parties having made unsuccessful experimental reunions. Isaac Baty founded his petition for divorce from Margaret Baty on the ground of mutual separation. Giving his decision his Honour said an unusual course of procedure had been adopted by the parties after they had entered into a deed of separation in 1925. Apparently the parties, although separated and living in different towns, made more or less a habit of spending their holidays together; they resumed ordinary marital relations and then parted, the parties retiming to their respective occupations. The petition was dismissed with costs on the lower scale. His Honour added that the fact remained that petitioner had alleged mutual separation and in his 'view petitioner had not been able to establish that.
