SALE OF HORSE AND GIG
CLAIM AGAINST ESTATE. EVIDENCE “UNSATISFACTORY. > ’ Before Air. J. H. Salmon, S.M., at the Hawera Magistrate’s Court, this morning, Kuratau Whaipakanga, otherwise known as Kuratau ot Hawera, proceeded against the Public Trustee as administrator of the estate of William Woller, deceased, seeking £ls as the purchase price of a horse and gig and harness sold to deceased in November, 1929. Mr E. M. Beeehev appeared tor plaintiff and Air. A. K. North for defendant. . , The sale was hut the defence contended that the debt had been discharged by payments of £5 andl £6 and the transfer of a bull. After hearing the evidence of several witnesses the magistrate said that the case was an unsatisfactory one. As a general rule in claims against deceased estates it was well known that the court looked at the facts with the greatest care, even suspicion. The evidence of plaintiff and her husband had left him in doubt as to whether the property in question had actually been hers or his, and such was the unsatisfactory nature of the evidence generally that he could not find for plaintiff. Judgment was entered for defendant with costs.
