A LEGAL INTERPRETATION. TEST CASE A‘T 'CHRISTCHURCH. (By Telegraph —Press Association.) CHRISTCHURCH, June 16. The Magistrate, Mr. Moseley, to-day gave Ins reserved judgment in the charge against H. Goggin, acting secretary of the .Metropolitan Trotting Club of a .breach of the Gaming Act, by unlawfully permitting to be received an investment on the totalisator otherwise than at the totalisator itself. Defendant was iconvicted. As the case was a test, he was ordered to pay costs only. “It must, I think, he accepted that the word totalisator means buildings in which bets are made and machinery by means of which they- are recorded, totalled and exhibited,' dividends computed and the place where they are paid. Accepting this definition as correct, I am o:f the opinion that a small room or box office not connected in any way with the totalisator as defined above, is not part o'f the totalisator and that any member, officer, agent or servant of any racing club receiving or permitting to be received any investment on a totalisator in such a room or box office commits a breach of Section 32 of the Gaming 'Act. In my opinion there is no legal difference between a box office situated *in the stewards’ stand and one situated in the members’ motor ear paddock a quarter of a mile away. The defendant will be convicted,, but as this l is a test ease he will be ordered to pay costs. ’ ’ The costs amounted to £3 13s.
