I/- A SOLICITOR’S CASE. M AUCKLAND MEDICAL APPEAL. (IIY TELEGRAPH. PRESS ASSOCIATION.) WELLINGTON, July 9In the Appeal Court, in re Henry Edward Elliott, a solicitor who was being dealt with for failing to have liis trust accounts audited, Mr. Clair, who appeared for the respondent, mentioned that he had not yet heard from his client. The Court agreed to let the matter stand over in the meantime, the Chief Justice remarking that evidently the respondent did not desire anything further to be done in his favour. The Court is now hearing the appeal of Dr. Henry Dundas Mackenzie, who was represented by Mr. Myers, K. 0., and Mr. McLiver, against the decision of Judge Herdman in favour of the Medical Hoard of New Zealand, ordering the appellant’s name to be removed from the medical register. The grounds for the appeal are that the reasons for the order are erroneous in law and fact, and the board’s contention was not proved ; also that the Judge rejected evidence which ought to have been admitted, by limiting the number of witnesses who gave evidence as to treatment received from the appellant.
