EMPLOYERS’ APPEAL DISMISSED, p WELLINGTON. June 20. The Court of Appeal to-day ( J ellve " ed judgment in the appeal by th New Zealand Harbour Boa-d Em ployers’ Union versus Mr. Justmc Tyndall and others. The Court h c -d intimated at the hearing that appellant’s argument as to the Award be ing void for ambiguity must be iected. To-dav a unanimous judgment of the Court rejected the appellant’s other contentions, and dismissed the appeal, thus upholding tne ddecision of the Chief Justice in the Supreme Court The result is ihar the writ of certiorari to quash the 1941 Award is refused. The Court could not accept the contention that Che Award was void for lack of jurisdiction on the part of t’he Arbitration Court, or that principles of natural justice had not been followed in making it. The result is that the 1941 Award stands, and the Arbitration Court mav proceed to adjudicate on appeals arising from the disputed clauses.
