Round’, of Riddler s Crescent, Petone, a'panel beater, is in a grave- condition from head injuries, caused by the overturning of a ear on the Hutt Road.. .L. C. Adams, 24, a striker at the Hutt railway owukshops, to whom he was giving a lift, was also injured. The car apparently went into a skid, on a bend a mile south of Petone. In the Supreme Court, Eliza Smart, widow and' executrix in the- estate of Edward James Smart, of Petone, claimed £.297 14s 3d l sP ee ial, and £l7OO general damages against Leslie Charles Morrison, taxi proprietor, and James Miller Pointon, taxi driver, on the ground that her husband’s death was caused by Pointon’s negligence in failing .to avoid 1 him. The defence denied that the death was paused- by the accident and also questioned items in the claim for particular damages.. The jury awarded £270 10s spec-i. al damages, and £637 general damages. The. foreman explained that the amount of general damages was that which the jury estimated was necessary to pay the plaintiff £3 a week for seven years, interest being allowed for at Hie rate of 3| per cent.
