The libel action against Sio-vwiigh* was continued to-day, Air O’Leary y for defendant said the formula had been prepared by Ruddle, an analytical chemist, and ho and plaintiff had sold it to the company, which was registered as the Nad'-s Company. The sale of the formula was a complete sale of all rights connected with it. It belonged wholly to the Nados Company and whnn Boddin was getting money on it in Wellington he was acting fraudulently. Counsel submitted that when a general charge of dishonesty was made, ami not a specific charge on a certain date, it was sufficient for a plea nf justification to prove that plaintiff ha.] acted as was alleged, even although defendant did not have the knowledge of those acts at the time he made his allegations. JUGGLING WITH CHATTELS. WELLINGTON, June 13. Evidence on behalf of the defendant was given by Ralph Neville White, solicitor. Auckland, who said that his film acted for tho Ideal Loan Company. In May. 1930, plaintiff was located in Christchurch, and after a summons had been issued, plaintiff wrote to the Secretary of the Company admitting that he owed money and had sold the chattels mentioned in the bill of sale. When Mr Evan Scott was crossexamining witness on the various bills c*’ sale executed by plaintiff. His Honor interposed. “Well, all the niggling in the world won’t get over the admission made by this man in his own handwriting. Tie gave a bill of sale over a truck and certain furniture and then sold them, which is absolutely illegal and a criminal act. H n cleared out with the money, leaving the mortgage behind.” Evidence was given by Marguerite Helen Miller regarding the agreement with Boddie, which she signed. RODDIE S VERACITY QUESTIONED. WELLINGTON. June 1-3. William Thompson Neill, a retired public, servant in Wellington, said he was offered a one sixth share in the business for £75. lie consequently took a one twelfth share for £37/10 Os lie considered that Boddie has not been straight nor honest.
