HONOLULU VERDICT Defendants Will Contest It (Aus. & N.Z. Cable Assn). HONOLULU, April 29. Pale, but game, the ’defendants in the Fortescue trial for the Honolulu murder, forty-eight hours after the case went to tho jury, heard the Foreman tell the Judge that they hud not reached an agreement, but that they still thought it possible to obtain a verdict within a reasonable time. Mrs Fortescue, Lieut. Massie, and the U.S.A, sailors returned to thoi>’ hotel disappointed, but smiling. HONOLULU, April 30. The four defendants in the Joseph Kahahawai lynching case have been convicted of manslaughter by the jury, with a plea of leniency. The maximum penalty for manslaughter is ten years imprisonment. Those convicted are: Lieut. Thomas Massie, Mrs Granville Fortescue. E. 5. Lord, and Albert Jones. They will be sentenced on May G. ‘ Mrs Massie wept on her husband'r. (shoulder as the verdict was announced. Mrs. Fortescue took it calmly, but she was visibly shaken, she having been confident of acquittal The naval, Lord, passed the other naval, Jgnes, a piece of currency, evidently paying a bet on the verdict. The defendants arc remanded in the custody of the Navy. The defence gave notice of a motion for a new trial, and announced that they will appeal if that is denied. Many residents rushed up and shook hands with the defendants, expressing sympathy. One prominent woman civic leader kissed all the defendants warmly. COSTLY COUNSEL A Honolulu resident writing to u Greymouth relative states that the United States Navy people put up 40,000 dollars (approximately £8000) to bring live lawyers from the United States for the defendants in the above ease. One of the lawyers, Mr Darrow, is stated to be the most capable lawyer practising in the United States to-day in this class of cases.
