LITIGATION OVER A 115 DEPOSIT. [Per United Press Association.] WANGANUI, August .10. The Maoris displayed consideruble i.itcrest in the Court to-dny, when Wharckuru Timoti proceeded against 11. M, Downs, Manager of the Katana Bunk, on July 10th, 1924, alhging- that Downs, by false pretences, to wit, a statement that the informant was entitled to receive i’Bo from the Katana Bunk, in return for an investment ot £5, did procure the i’s to be deiivereo to said Downx, as representing the Bank. The iuformii.it stated he deposited £5 with Downs and the See rotary at the Bank, and received Si coupons, which indicated they were worth £1 each. He was told that it he paid in £.', he would receive i loan of £BO.-- He made two applications for a loan, but without success.' On the first oeeasio.i he was told then was no money in the Bank, and on the second occasion X'owns told him the coupons were not worth £l. FURTHER DETAILS. Downs (a director of the Katana Bunk) for allegedly obtaining money under false -preteu' e«. After some discussion by counsel, the civil element uzis waived, ami the action proceeded iin indictible one. Some two months Liter, when he went to Downs for a loan the latter told him no money' was available. The Magistrate slid that, on the information before him, he eonbl not see where a ease of false pretencef lay. It seemed to him that the matter involved a breach of contract, and. therefore, was purely a civil matter. The information would therefore be dismissed.
