AFTER RESPONDENT’S DEATH. LONDON, April Is. Tho decision in the Kent case wo given in favour of the husband. Kent claimed damages from the •-o-re.--.poii-dent in a divorce action he brought against his wife, who died before the hearing was commenced. The question to be decided was whether the wife's deMtn nullified the husband's claim. The judge said that it was not the sort of claim many men would be likely to bring. He had never known such a claim to he brought before but he had come to the conclusion that under common law an action for crim inal conversation could be maintain ed by writ issued after the death of the wife. He could not think because the course of nature made service on the wife impossible, a suit against the co-respondent could not be maintained.
