WARDEN'S COURT, AHAURA,

Friday, December 6. . (Before Mr Warden Whitefoord.) Daniel O'Rielly and party applied for protection for a prospecting area of 500 ft by 2000 yds, on the ranges between Duffer Creek and Noble's. The Warden said the Court had not the power to grant the area of ground applied for, and quoted from the Regulations, defining the limits of the area 3 the Court might grant. The applicants said the ground was very difficult to prospect, rendering the driving of long tunnels and the prosecution of other expensive works necessary. It would be six months before the company, with continual work, could test the ground, and it waS now lying useless, The Warden said he was disposed to place every "facility in the sray of prospectors, but he could not go outside his authority. The Company might take 60ft x 1000 ft frontage for each member, with permission to amalgamate hereafter. The applicants said the area offered was not large enough t© induce them to enter into the undertaking. , The Warden said in that case he had no '

option, and would be compelled to refuse the application altogether. Subsequently Mr O'Eeilly, who appeared for his Company, 3aid he would accept the ground awarded by the Court. The Warden said he was now too late, but a fresh application could be made after the rising of the Court. Malcolm Graham and party obtained permission to alter the boundaries of an extended claim at Half-Ounce, by shifting the pegs 30ft in one direction. Louis Corloni and party applied for a' double area of 104 ft x 208 ft of auriferous ground at Napoleon Hill. William Watson and party applied for a double area on the supposed course of the Browne's Terrace Lead, Noble's District. The applicants urged in support of their request, that the lead as it ran downwards became very wet and difficult to work, and also that several extended claims had been granted high up the lead, where the ground was dry, and could be comparatively easily wrought. The application was opposed by Henry Eccles, on the grounds that the lead could be profitably worked in ordinary claims ; that the granting extended areas on it would be creating an injurious monopoly ; that the applicants objected to a similar application when made by Andrew Nicol and party ; and finally, that the applicants already held other ground on the lead. The applicants denied that they held any ground besides that now applied for, and in the case of Nicol and Co., they objected to that company getting 394 ft along the lead, which would clearly be a monopoly. The Warden saw no good reason adduced in support of the application for the extended area, and made a grant of 120 ft x 1000 ft to Walsh and party. Annie Bates applied for registration of a residence area on Devereux's Terrace, between M'Hardy's station and Drayton, on the Reef ton road. Granted. Thos. Bustardand party applied for an extended claim at Hafford's Terrace, Half-Ounce. Michael Cassidy objected, as 1 the area applied for included a tunnel in which he was working. * The application was granted, subject to the right of Cassidy to the regulation quantity of ground on each side of his tunnel. Michael Broderick applied for three acres old worked ground at Try- Again Terrace, Nelson Creek. Referred to Mr Surveyor Hall for his report. In the case of Philpotts v. Sinclair; an application that the Court would interfere to dissolve the partnership between the complainant and defendant, and make a division of the assets, there was no appearance of the complainant. The following unopposed applications were granted: — John Fitzgerald and party, for registration of a head-race and tail-race at Antonio's Flat, Litble Grey ; Hallman and party, for an abandoned dam (formerly M'Donald and party's), at Half-Ounce 5 Isaac .Haggoian and Peter Holmes, for a frontage claim at Browne's Terrace ; Hans Christopherson and party, for a similar application. The Court wa3 adjourned to the 13tb December.
