AUCKLAND, Jan. 12

Last night a young man,;Eric Geo. Oliver,'was assaulted and robbed by ivro men in Myers Park. Constable Massey heard voices coming from the-direction tof a convenience at- the lower end .of /the park, and flashing his - torch -along (the side of the, convenience, viie saw three men struggling on the ground. Two men . were punching, a third. When the two men saw the-constable, both stood up and made an attempt to escape. Constable Massey then drew his: baton and struck one of tlie men across the forehead. He staggered and fell to the ground. Tb e constable caught hold of the other man wlio, after a struggle, said that lie would ‘ f go quietly”. W 7 hile the constable was handcuffing >this man, Oliver was trying to : bold the other man on the ground. . Before Constable Massey cOuld go to bis assistance, however, the other assailant got to his feet and ran up through Myers Park. Several letters and a bank pass book belonging to Oliver were scattered on the grass. At 2 o’clock this : morhing Constable Massey went to BeresfOrd Street aiid' arrested the otßdr'man. Ho was in bed bleeding from a cut on bis fore\olivcr, in a statement to the police, alleged that both men, after punching him, rifled bis pockets and stoic 3s 3d! They tore his left trouser pocket and turned bis inside coat pocket °ut, also pulling up bis shirt to sec if be wore a money belt. Oliver’s injuries consisted of a blow on the left eye with abrasions, while one of his teeth wab-broken off.

This morning Claude -Harold Miller, aged 21, and Leslio - John,- M 7 aiding, 24, a hawker, appeared before Mr. Hunt, S.M. Miller was charged with assaulting Oliver and were each charged with ’robbing' Oliver of 3s 3d and at the time of, or immediately before such robbery-using personal violence.

A remand was granted, bail being refused.
