COLLECTION SUSPENDED
C-OURT HEARS COMPANY’S CASE. SYDNEY. April 26. Mr. Hughes says that, pending <+ decision of Court. the collection of totalisator tax will be suspended. (Received April 26. 9.45 p.m.) SYDNEY. April 26. The Full Court heard the Automatic Totalisator Company’s application for an injunction to restrain the Federal Commissioner from imposing the 13 per cent, tax on investments. Plaintiffs contended that the tax could not be levied and that the toi~ .alisator was not a lottery within the meaning of the Income Tax Act. Counsel for the Commissioner declined to address tlie Court, submitting that the case in favor of the imposition of the tax was not arguable.
Judgment was reserved.—U.P.A
