A MOTU CASE
W TELEGRAPH—SPECIAL CORRESPONDENT] AUCKLAND, May 27. At the Magistrate’s Court to-day Mr C. C. Kettle, S.M., agreed to the withdrawal of the judgment given on April 9 in the case F. J. McManemin (Mr E. McCormack) v. J. P. Gordon, of Motu, Gisborhe (Air Glaister), for £2O 11s 6d. Defendant’s counsel urodueed an affidavit to the effect tliat the defendant had not been served and that tlio case was decided without liis knowledge. As a result of tho judgment the defendant’s credit had been damaged in regard to several Auckland wholesale firms. Air Kettle remarked that if the constable’s affidavit of service were incorrect tlie defendant might have a claim for damages for loss of credit.
