CIVIL SITTINGS

(Before His Honor Mr Justice Chapman.)

The civil sittings of the Supreme Court were oommenced on Saturday morning at 10 o’clock, tho fiat ease taken being that of Ba>k9r versus Dick-on olaim for specifio performance of sale of lOf aores at Kaiti. Mr Slock with Mr Lush appeared for p’aintiff, and Mr Rees wTh Mr Sainsbury for defendant.

Mr Stock stated that the property was put into the bands of tho Intercolonial Laud Agency Lr sale in February, 1904 the prioe beiog £2OOO la August, 1905, Mr DeLautour, of the lotoroolonial Land Agency, told Mr Dickson that he had a purchaser at £2OOO. Mr Dickson agreed to take this clear, and said ho would first have to tajke it out of the bands of a JPalmerston North Agency Whoa told that the purchaFer was Mr F. B. Barker, defendant expressed satisfaction. Evidence would be given to show that the property was withdrawn from the Palmerston No th agenoy, and that Mr DeLautour entered into a contract with Me Barksr for tho sale of the property to him. In support of ti e plaintiff’s oass evidence was given by O. B. DeLautour, commission agent, carrying on the business of. the Intercolonial Land Agenoy, H. E. Hill, and Vincent B irk-sr.

For tho defence it was contended that there was no authority given either verbally or in writing to Mr C, B. DeLautour to soil as agent by MrDioksoD. His Honor reserved judgment.

IN CHAMBERS.

In the matter of the estate of George Bruce, deceased, further motion for direction as td whom the summons shall be served upon, an order was made as moved, service to be on adult defendants, and on the guardian ad litem of infants. Ia the same an order was made settling the apportionment of root due from property leased to A. R. WatsoD, on the basis of Mr John Clatk’s slliiavit, costs of all parties to be settled by tho Registrar, twothirds by estate and ono-third by Mrs Bruce.
