Customs Breach: Heavy Penalty On Retailer

AUCKLAND, This Day.—For being in possession of uncustomed goods—64 ball-pointed pens and 66 refills-John Patrick Newm-m a Queen street retailer, was fined £25 in the Police Court today. The pens and iOl which he paid £97 10s, were said to have been confiscated. , The Customs Department prosecutor said these pens of United States and Canadian origin were not yet on the New Zealand market; because of import licensing. The principal of the master agents said that, if available here, they could be retailed for 17s 6d cnch. The defendant said he had paid 27s 6d for the pens and 2s 6d for the refills to an unknown man, who said he had a licence to import. The defendant surmised that the duty had. been paid. The Magistrate, Mr J. Morling, imposing the minimum fine, said that to accept the word of a casual man coming to the shop was not sufficient discharge of liability.
