CONVICTION QUASHED

A wrong statement given by ail accused person concerning his age led to proceedings being taken in the Supreme Court at Auckland last week by the Attorney General to quash a conviction against him and have it removed from the records. The accused concerned was Kenneth Cropp, who, when he was charged before Mr J. H. Luxford, S.M., on May 17 of last year with the theft of £lO, gave his age as 22. He was convicted and placed on probation for 18 months.

Mr Rosen, who represented the Attorney-General, said that at the time of his conviction Cropp was only 16 and therefore the Magistrate’s Court had no jurisdiction to deal with him.

His Honor said that clearly Cropp should have been dealt with by the Children’s Court with all the protection that afforded him. The conviction was without jurisdiction, and His Honor made an order quashing it accordingly.
