FORMER MAYOR FACES LAND SALES CHARGE

(P.A.) AUCKLAND, This day. Decision has been reserved by Mr J. H. Luxford S.M., in a case in which it is alleged an “under the table” payment of £4OO was made for a house and property at Milford, an Auckland marine suburb.

A land agent, James William Hayden, and George Lambert Bruce Whillans, retired, were charged with breaches of the Land Laws Amendment Act, 1944. Hayden was charged with procuring and also inducing William Norman Waite to make a secret payment of £4OO to the vendor of the property, Whillans, and Whillans was charged with procuring the payment through Hayden as his agent. The accused were also jointly charged with scheming in contravention of the Servicemen’s Settlement and Land Sales Act. Pleas of not guilty were entered to all the charges. Hayden in evidence denied the allegation of a secret payment. He said he was a former Mayor of Takapuna, and a former chairman of the Waitemata Power Board. Whillans denied all knowledge of a secret payment. After lengthy evidence, the magisstrate said he would give a written decision in view of a recent Supreme Court appeal.
