PUT OUT OF RAID SHELTER
JUDGE'S COMMENT
LONDON, December 5. Judgment for £5 was given by Mr. Justice Tucker in the King's Bench Division against Cumberland Hotel Ltd., proprietors of Maison Lyons Corner House, Marble Arch, in the action brought by a customer of the Corner House, Mr. Henry Cooper, Sussex - place, Hyde Park, W. Mr. Cooper complained that during an air-raid he was ‘'flung up the stairs from a shelter and pushed out of the restaurant.” The defence was that he left of his own free will. Mr. Justice Tucker said that Mr. Cooper had very largely got himself to thank for the situation in which he was placed and had considerably exaggerated the incident. “I think the truth is that he was being anything but helpful in the emergency,” he said. “As the defendants have not sought to justify their conduct, Mr. Cooper is entitled to succeed.” He declined to make a special order as to costs, and said they would follow the rule.
