USE OF EXPLOSIVES
DAMAGES CLAIM' FAILS. [PER PRESS association.] WELLINGTON, October 17. Judgment for the defendant, Michael Gordon" Templeton, a contractor, of Wellington, was entered by Mr. Justice Smith in the Supreme Court, Wellington, to-day, after a jury of four had considered a case where Mary Elizabeth Blanche Bradley, a widow, of Penrose Avenue, claimed damages amounting to £328/14/-. Plaintiff alleged that explosions on demolition work at the Wellington Public Hospital adjoining her property had caused her shock, brought about a nervous condition and anxiety, and had rendered her incapable of fol- 1 lowing her occupation. The defence] was a denial of negligence. When the hearing of the ease, which opened yesterday, was concluded today, two issues were put Io the jury: (1) Was tlie defendant negligent in using explosives; (2) if so, did the negligent use of explosives cause the injuries of which plaintiff complained. The jury, which retired at 1.7 p.m., returned at 3.30 p.m.. and answered in the affirmative to the first question, but. in the negative to the second.
