LIQUOR SOLD

MEN FINED AT OAMARU. [PEB PBEBB ASSOCIATION.] OAMARU, February 16. Fines with costs totalling £42 10/-, were imposed on Charles Marks and Ernest Boulton for breaches of the Licensing Act; by Mr. H. Morgan, S.M., at the Oamaru Magistrate’s Court this afternoon. Some charges were withdrawn by leave of the Court. Mr. C. Zimmerman appeared for the defendants, who pleaded guilty. Sergeant McGregor said that for some time the police had known that a traveller from the United Service Hotel. Christchurch, came to Oamaru soliciting orders for liquor, and selling liquor. On' December 9, Marks had a considerable quantity of liquor in a car, which was seized by the police. Marks was a cellarman at the hotel, and admitted that he was sent by his! employer to canvass for the sale of liquor in Oamaru. Boulton admitted that he sent Marks to Oamaru to solicit orders for liquor, saying that .he had received legal advice that it was legal to do so. Mr. Zimmerman, in addressing the Court, said that this was the first and would be Boulton’s last breach. He had received legal advice, and as it was now possible to solicit for orders in Ashburton, that was probably the reason for the misapprehension about Oamaru. It was unthinkable that the proprietor of a. leading hotel in Christchurch would risk losing his license for such breaches. Mr. Morgan commented that the licensee certainly had very bad legal advice. Marks was fined £5 for soliciting orders, £lO for selling liquor, and £5 for keeping liquor for sale in the nolicense district of Oamaru, and was ordered to pay costs. Boulton was fined £5 for sending liquor without order, and £l5 for soliciting orders for liquor in the no-<license district of Oamaru, and was ordered to pay costs. An order was made for the confiscation of the liquor seized, the value being pul, down at £l5.
