LYSNAR AND BANK

FURTHER LITIGATION. [PER press association.] GISBORNE, August 17. Further litigation between William Douglas Lysnar and the National Bank, in connection with the Arowhana station, which has been tho subject of several important action:) between the parties, commenced in the- Supreme Court, this morning, before Mr Justice Blair, when Lysnar proceeded against the Bank on a claim totalling £51,409, plaintiff alleged the bank had taken a course to which it bad no right in law, and the main item of the claim was for loss of equity in the station £22843. He also claimed for chattels seized and dam ages for their retention. He alleged also that, tho bank had illegally occti pied and used an area of 115 acres adjoining the station, none of this land nor the chattels being included in the bank’s security.

The defendant bank, in a. counter claim, set out that Lysnar was indebted under a security instrument for £73,<819, on July 1931, on which date the bank ma.de a demand for payment, and plaintiff failed to pay. Plaintiff appears in person. Messrs T. C. Hislop, D. E. Chrisp, jmd Bowles aro appearing for the bank. When the case was called, Lysnar said he considered it unwise to proceed at this juncture pending a decision of the Privy Council on the earlier litigation.

Mr Hislop said the present matters differed from those already decided. The bank was not prepared to assent to an adjournment.

The Judge directed the hearing to proceed.
