FOUND SHOT. INVERCARGILL, October 14. Thomas Albert Henry, aged 55, a taxi proprietor, was found dead, this evening, near the railway line in the vicinity of Rugby Park, with a bullet wound in his left breast. The body was lying on one side of a fence, and a rifle on the other. LICENSEE FINED WHANGAREI, October 14. At Kaikohe yesterday, Leonard William M’Lelland, licensee of the Ohaeawai Hotel, was fined £lO for selling liquor after hours. The accused was also fined £5 and had his license endorsed for selling liquor to young men to take to a dance at a Maorp pa. WAIROA ’QUAKE. WAIROA, October 14. The monthly meeting of* the Wairoa branch of the Farmers’ Union passed the following, resolution unanimously:—“That this branch of the New Zealand Farmers’ Union desire to impress on the attention, of the Government, that unless the national appeal is taken up more seriously than it is at present it will be absolutely necessary for the Government to substantially assist the farmers in the stricken area of Wairoa, to rehabilitate this devastated district.’’ It was also decided' that a copy of the resolution be forwarded to tho Dominion Executive soliciting its support.

WAIROA CRASH APPEAL. WELLINGTON. October 14. In the Appeal Court case, Dominion Ltd. v. Strand, Mr Cleary for Strand, submitted that there was a definite connection or nexus between the breach of the regulations and the accident, because, if the regulations had been observed, the pilot Kight, would not have been in charge of a plane. The contract of carriage had been made on the assumption that aviation regulations had been complied with. There was no evidence that Strand knew that the appellant Company had committed a breach of its statutory duty in permitting Kight to pilot the plane. If the respondent had known that Kight was debarred from piloting a plane he would have accepted the position and travelled at his own risk. After hearing Mr P. B. Cooke, counsel for appellant, in reply, the Court reserved its decision.
