IN BANKRUPTCY

“BEAUTY SPECIALIST’S” FAILURE (Special to "Star.") AUCKLAND, February 24. A- session in bankruptcy was held in the Supreme Court to-day before Mr Justice Blair. There was no opposition to the motion for the annulment of the bankruptcy of Dr. H. W. Dundas Mackenzie, and the order was made accordingly. His Honor said that he had road the papers and the matter appeared to be in order. The application of Florence Chatterton, .beauty specialist, for discharge from bankruptcy was opposed by Mr Vialoux, representing the principal creditor. He said that the case came

before Mr Justice Stringer some time ago and was adjourned in order to allow the debtor to consider accepting a judgment made against her. It was stated that trust moneys were involved. “The bankrupt is not here,” said counsel, “and I understand she has advertised extensively, announcing the fact that she is leaving the •country. I should like the case adjourned for a week in order that I may issue a subphoena to get her before the Court.” His Honor: I see there is a suggestion that some moneys disappeared shortly before the adjudication. Mr Vialoux: That is so. There does not appear to be any machinery in the country to prevent a bankrupt from leaving. The adjournment was granted. There was an unexpected development in the case of an Op.otiki farmer who appeared to answer a petition for his adjudication as bankrupt. The petitioning creditor was not present and the judge pointed out that under these circumstances respondent was entitled to have the application struck out if he so desired. “I would like it struck out,” said the farmer. His Honor: You are also entitled to costs. Do you apply for them? Respondent: Yes please sir. I have been' put to a lot of trouble. Costs totalling £9 12/- were allowed. The farmer created some amusement by inquiring “Where do I get them?” His Honor told him he would have to wait, and the farmer departed apparently well satisfied with the outcome of his case.
