Judgment in cases arising out ot the refusal of certain workers in the allied iron trades to ,work overtime last September was given by Mr Wilson, S.M., to-day. The Inspector of Awards claimed £200 each from the Auckland Boilermakers' Union, and the Amalgamated Society of Engineers, and £200 from It. F. Barter, secretary of the last-named union.; and £400 from A. H. Phillip, secre-, tury of two other Judgment for £50 was given for plaintiff against each union, and judgment was given for the union- secretary, on the grounds that the claims against them might be treated as being alternative to the others. The Magistrate said he had found that the workers individually had the right to refuse to work overtime, and Tn the case of an individual he would have to find that he had not been guilty of striking. In 'the present case, under the direction of their unions, the men had refused overtime, not as individuals, but as n body, as a means of compelling cei;taim employers to concede certain pay-, ment to other unions, and, therefore, converted the right or privilege into a means of compulsion as against those employers. The magistrate considered this constituted an unlawful strike.
