MARE IN FOAL
HIT BY RfIOTOR CAR OWNER AWARDED DAMAGES A sequel to a mishap on the T a kail ini straight when a motor ear hit a mare in foal, was heard in the P'apakura Court. The case concerned the owner of the mare, Mr Millen of Patumahoe, who claimed £isC> 15s damages against James Morrileau, formerly of Papakura. Mr F. 11. Levien. S.M., in delivering judgment for plaintiff, drew attention to the fact that the mare at the time was six months in foal to a stallion which had some merit. “My own impression is that defendant has mis-stated the facts to me. It does not matter where the mare was on the concrete or not: he had to make provision for it and if lie did not,, he is guilty, in my opinion, of negligence. The mare fell sick two days after and aborted, the foal being still born. Negligence, the magistrate contended, had been proved There was also the fact that it cost, £5 5s to put the mare in foal. Judgment for £25 would be given as compensation.
