FAIR RENT
DUNEDIN APPEAL CASE (P.A.) WELLINGTON, March 4. The Court of Appeal to-day commenced the hearing of argument on an appeal by Service Buildings Ltd., as the lessor of premises at 471 Princes street, Dunedin, used as a motor garage and showroom, against a judgment of the Supreme Court on January 6, 1.944, on a motion by the present respondent, Todd Motors Ltd., as lessee, fixing the fair rent of the premises at £624 per annum, the order to be retrospective to January 14, 1943. The appellant relies on an amendment to the Economic Stabilisation Emergency Regulations, which was introduced on November 26, 1946, and which established a right to appeal against an order fixing a fair rent. In the course of preliminary argument, counsel for Todd Motors intimated that he would submit that this amendment was unreasonable and invalid as being in excess of the regu-lation-making power of the Legislature, and that the present appeal would provide an opportunity to review the whole nature of the emergency regulations.
Argument was unfinished when the court adjourned.
