FORMAL RECOGNITION OF DEATH ELECTION PROCEEDS (Special). WELLINGTON, June 10. There will be no delay in. filling the vacancy in the representation of the Waitemata electorate caused by the death of Captain Lyon, killed in action. The suggestion has been made in Auckland that difficulty would arise in proving actual death owing to the special circumstances, but this has been disposed of by the issue of a formal certificate of death by the Registrar-Gene-ral. This has been received by the Speaker of the House, Mr Barnard, who will take the steps indicated in the Legislature Act. The position appears to he that, as Parliament is sitting, the death of Captain Lyon can bo reported to the House, w'hich may then pass a resolution directing Mr Speaker to proceed with the issue of a writ to fill the vacancy. However, the passing of this resolution is not essential to the procedure being completed, as Mr Speaker may gazette the vacancy, the usual steps for an election being thus set in motion.
