TUESDAY, AUGUST 13. I (Before Mr J. R. Bartholomew, S.M.^ DEFAULT CASES. Judgment, by default, with costs, was given for the plaintiffs in the following cases :—A. M. Hammer (Outram) v. Michael Kitchin (Awamanga), £5, money lent; Farra Brothers Ltd. v. E. J. Bissett (Kaitangata), 18s 6d, goods supplied; Abbott, Armstrong, and Howie (Auckland) v. William Henry Armstrong,, £42 15s 6d, goods supplied; A. Taylor and Sons Ltd. v. R. Ross, £l. goods supplied; A. L. S. Cassie Ltd. v. George Rae Shaw (Kurow), £8 7s 9d, goods supplied; Keith Ramsay Ltd. v. James Smith (Drummond), £4 Is 6d, goods supplied; Reddells Ltd. v. Robin Favel (Waikaka), £5 11s 9d, goods supplied; Ivor Robert Prescott v. J. S. Connor (Mosgiel), 15s, goods supplied; Inspector of Awards v. A. Johnston, £2, breach of grocers’ award; James Mulholland v. Henry Moir (Green Island), £5 Os sd, work done. PARTNERSHIP PERCENTAGE CLAIM. The reserved decision was given in the case in which K. Bethune proceeded against the partnership firm of Bethune and Patrick claiming the sum of £sl 10s 4d, being the share, of the contract moneys (£1,030 8s) at the rate of 5 per cent, agreed to be paid to the plaintiff in respect of the contract entered into by or on behalf of the partnership firm with the Dunedin City Corporation for certain works at Deep Stream; and the further sum of £8 9a 9d, being the share of the plaintiff as a partner in the firm in the balance of the partnership moneys available after payment 6f the sum of £sl 10s 4d, Mr C. J. Rawlinson appeared for the plaintiff, and Mr J. E. 'K. Mirams for the defendant. After reviewing the evidence Hia Worship said that although the defence denied it had been agreed to pay the percentage claimed, he could not accept that evidence. He, therefore, gave judgment for the full amount (£6O Os Id), with costs (£l2 11s 8d), for the plaintiff.
