CIVIL COURT PROCEEDINGS

Claiming a total of £3OO as money lent and interest due, Wilhelmina Moir proceeded against Catherine Wallace in the Magistrate’s Court this morning, Mr J. R. Bartholomew, S.M., presiding. Mr O. J. L. White appeared for the plaintiff and Mr B. S. Irwin for the defendant.

The statement of claini set out that the sum was made up of £2OO, money lent to the defendant in October, 1929; £6, interest thereon from July 1, 1934, to January 1, 1935, at 6 per cent.; a further £l2O, money lent in February, 1932; £ll 4s 6d, interest thereon from February 18, 1932, to March 8, 1935, at per cent.; less tho amount abandoned in excess of £3OO to reduce the amount to within the jurisdiction of tho court. . Evidence was given by the plaintiff, who gave details of the money loaned, and denied that she made a gift of the money to the defendant. To Mr Irwin, the witness said she had loaned money to other persons. Isabella O’Connell also gave evidence. There had never been any dispute regarding receipt of the money, said Mr Irwin. The plaintiff urged the defendant to buy a certain business, and loaned her the money for the purpose. At a later date the plaintiff made a present of £IOO to the defendant, and there was never any question of interest. He submitted that this money was a gift, but that now the plaintiff wanted it back. In evidence the defendant said that the sums of money she had received were gifts, and she bad never been asked to pay any interest. (Proceeding.)
