LEGACY CONDITIONS
HELD TO BE INVALID LONDON, May 15. Mr Justice Luxmoore, in the Chancery Division, considered the will of Charles Augustin Treverbyn Prideaux, a barrister, who died in February, 1930, and who made a will containing curious restrictions. “ I give the following gifts,’’ ho stated, “ on the condition of no person interested eating foie gras or any crab, eel, crayfish, lobster, prawn, _ shrimp, or any shelled or other animal or creature without absolute proof of humane death or killing of such creature before cooking and with the least possible pain; or from wearing any feather, skin, or part of any bird or'other animal as an ornament or as trimming.” Persons disregarding tho testator’s wishes were to forfeit all benefit under the will. The administrators desired to know whether the condition imposed was valid. The R.S.P.C.A. were tho residuary legatees. Mr Justice Luxmoore hold that the condition was invalid.
