DOCTOR VINDICATED
MIC CONDITION NOT ALCOHOLIC MOTOR PROSECUTION FAILS [Per United Press Association.] CHRISTCHURCH, January 20.- “ Sometimes truth is even stranger than fiction, and that applies in this case. I am perfectly satisfied that the defendant was not intoxicated from the consumption of alcoholic llqiior, and I think that is the state of intoxication that is referred to in section 18 of the Motor Vehicles Act.” This statement was made in the Magistrate’s Court by Mr Mosley,; S.M., when John Ebenezer Kelly Brown, a doctor, aged 45 years, of Stanmoro road, was charged with being intoxicated while in charge of a motor car in* Hereford street' on December
21. The charge was dismissed, but the defendant was convicted and discharged for driving in a manner that was, or might have been, dangerous to the public, a count which was substituted after consultation.
Defendant gave evidence that he got up to attend cases while suffering from influenza. He had taken an influenza powder, aspirins, and a glass of port, and these were the cause of,his toxio condition. Other doctors gave evidence in support.
