JUDGMENT SUMMONS.

John P. Baird was ordered to pay Parker and Lawson Ltd. £lO Os Id, with costs (£1 4s), in default eleven days’ imprisonment. RESERVED DECISION.

The Magistrate gave his reserved decision in the case jn which Alexander Stewart Stephen proceeded against George William Kjdcl on a claim for £l5O, the amount paid by the plaintiff to tho defendant as deposit in respect to tho purchase of a hotel, and £7B 5s 9d, damages arising out of tho defendant’s failing to complete the sale after ho had arranged to do so, was resumed. Mr E. J. Anderson represented the plaintiff, and Mr Neill the defendant. .. . Mr Bartholomew was of tho opinion that a definite contract was created between tho parties, and that it was the defendant's responsibility to do his best to arrange the finance. The plaintiff was entitled to judgment for the deposit money paid into court. His Worship intimated that ho would postpone entering judgment until counsel considered his position in. regard to the remainder of the money.:
