JUDGMENT AGAINST EMMOTT SHIEL An echo of a motoring case that aroused considerable interest in Dunedin last year was hoard in the Supreme Court yesterday afternoon, when tho Empire Motors, Ltd., assignees of the New Zealand Motoring and Engineering Company, claimed from Emmott Sh'iel £2OO damages in respect to a deal in motor cars Mr W. L. Moore, who appear cl lor the plaintiff, said tho case arose out of a transaction in which tho defendant exchanged a car that was practically useless for a valuable car. Clifford Peel stated that_ in 1927 lie was employed by the New Zealand Motor and Engineering Company. An exchange of cars was made between tho company and the defendant. The company was exchanging a Fiat car valued at £398, for which it was to receive £9S in cash and n Buick car valued at £3OO. The Buick car was represented to be in first-class order, but it turned out to be a very dilapidated second-hand car worth about £3O. Criminal proceedings were taken in connection with the transaction, and tho defendant was fined £2OO. Mr Moore said he would ask for judgment for £IBO, and the plaintiff could make use of any parts of tho Buick car that were useful. Judgment was given for tho plaintiff for £IBO, with costs £lO 10s, disbursements and expenses of witness to bo fixed by the registrar.
