Tho Appeal Court, consisting of Judges Reed, Ostler, Blair, and Smith, is heariiig the ease of J. G. Stewart v. A. C. Briggs. The appellant is a medical practitioner, of Milton, and the respondent is tho superintendent of the South Otago Hospital Board, ot Balelutha. The case arose out of a statement made to the board by respondent, in consequence ol which appellant brought an action for libel. The jury found for appellant, and awarded £25 damages. After the finding had been announced the action was adjourned for further consideration, and both parties having moved for judgment, Mr Justice Sim decided that Dr Briggs’s statement was privileged, and therefore entered judgment for respondent, .with costs. Appellant is now appealing from tliis latter judgment, on the grounds that it is erroneous, and that ho is entitled to judgment. For tho appellant; Mr Barrowclough appeared; for the respondent, Mr J. S. Sinclair.
