MAGISTRATE’S COURT

(Before Mr J. R. Bartholomew, S.M.) JUDGMENT BY DEFAULT. Judgment, by defaultfi with costs, •was given for plaintiff in each of the undermentioned cases; —0. M. Smith and Co., Ltd. v. G. T. Robie, £4 5s lid j Sarah. Jane Knowles v. William Miller, £2 3a sd; J. and R Woods, Ltd. v. H, M. Shaare, £ls 8s 4d. CASE ADJOURNED. Paterson and Barr, Ltd (Mr J. H. Gillies) proceeded against C. R. Sims (M.r Bavlec), contractor, for the recovery of £4o 16s Bd, for goods supplied. Evidence was given that two contracts were concerned in the transaction, and Adam Paterson, of the plaintiff firm, was with Mr Benton, then manager of Hogg and Co., appointed to take charge of the contracts, following a meeting of creditors, and disburse the money received from them among the creditors. The money from the contracts had been disbursed among the creditors pro rata, and p'lnfctii'ffj c'ftlnued that defendant had overstated the amount of t,ho contract in one case by about £IOO. and in the other by £l2O. There were two Government mortgages. For the defence it was stated that plaintiffs wero acting as trustees for the defendant, and for that reason could not sue on their own account. Defendant stated that he had given Mr Benton moneys to bo received from the Government, 'Witness was paid £3O wages to complete one contract, and was supplied with necessary materials. _ Tho case was adjourned until July 7*
