There was a full attendance of members at tho monthly meeting of tlio laieri River Trust. The Engineer detailed the work of the past month. Ho added that ho had completed the survey of Iho area, between the railway and hillside from otold a to Bull Creek, and forwarded a- plan showini; nil jintunil features and tho levels of the embankment, railway, and paddocks at every Jivc-chain distance. The plan gave on "one shoot all the information required to design a scheme ior either shifting back tho embankment alongside tho river or for raising tho railway so as to servo as an embankment. The levels had been reduced to railway datum. Ho forwarded also a plan showing the classification of the River trust area for the embankment rate. —The report was adopted. In connection with a request by the trust that the classifiers reconsider _ the excluding of some property in West Taieri from the rateable area, a report was received that the classifiers had no recommendation to make. Tho trust discussed tho matter of excluding Messrs Wright and Cameron's properties, and it was decided, on tho casting vole of tho chairman, to make no alteration. Mr N. Reid applied to have portion of his farm excluded from tho rateable area. —Letter received. A proposal to exclude all lands above tho channel and to clean no drains in the same area was lost. 'The engineer and tho member for tho subdivision were asked to report on tho application of Mr A. F. l)oull that a darn removed some months ago from Poplar drain, about fifteen chains below Henley School, be reinstated, or that tho pumping level be reduced one foot to give him drainage. The Clerk submitted a list of estimated expenditure for 1922-23 as follows Administrative account, £500; embankment account, £480; drainage account, £2,045. The fixing of the rates to provide tho necessary revenue was left over till next meeting. Tho Clerk reported that ho had consulted the trust’s solicitors as to the position of tlie trust in regard to borrowing money by way of overdraft during the current financial year. The, solicitors had replied that the revenue for tho year ended March 31 last had been £2,772 12s lOd, and that is tho amount that can be legally borrowed by way of overdraft during the current year. Tho trust must provide for its ordinary obligations and engagements in any year out of its revenue for that year, and must not, at tho end of any year, have an overdraft greater than such part of the revenues of the year then ended as remains outstanding and unpaid. Section 7 of the Finance Act provides that—“ Where, by reason of flood, earthquake, fire, or other accident, it becomes necessary to provide moneys to an exceptional amount beyond the expenditure estimated for the year then current, the local authority may, with the consent of tho Minister of Internal Affairs, borrow money, by way of overdraft or otherwise, to provide for euoh emergency: and such overdraft shall become part of the antecedent liability and bo extinguished as mentioned later.” Under tho provisions of tho Finance Act tho “ antecedent liability” of a local authority was tho amount owing at March 51 last, on overdraft at its bankers, pins sums owing to persons from whom it had received moneys on deposit. The trust was not authorised to receive moneys on deposit, and the overdraft was £7Bl 12s fkt, which therefore became the antecedent liability of tho trust. To extinguish the antecedent liability tho trust was empowered by tho above Act to raise a special loan without taking a poll of the ratepayers; or it might extinguish tho tamo by seven annual payments out of its revenue, and for such purpose was empowered to make and levy a special reclining rate for sovnn years or make and levy a special rate annually, such rate or rates to bo uniform and made over all tho rateable land in tho district. The clerk mentioned that tho Government Auditor would he in the district with him in a week’s time, and it was decided to leave the matter over until tho clerk had conferred with tho auditor on some of tho matters mentioned in the opinion.
