SUPREME COURT.--CIVIL SITTINGS. (Before His Honor Mr Justice Sim.) —Symo v. tho King.—The case Alexander Symo, of Otanomomo, v. lb© King, a petition for rights aa to damages by reason of tiro Clutha floods, was resumed this morning. Mr John MacGregor _ appeared for the petitioner, and Mr W. 0. MacGregor, K.C., for tho defendant. Mr J. MacGregor now stated that tho parlies wore agreeable to the case being removed to tho Court of Appeal. His Honor: You have set down a formal motion for judgment. Mr J. MacGregor; Acs. You will notice by the notice of motion that I have added’a now ground. His Honor : I suppose you can take any ground disclosed in tho evidence. An order was tlign made removing tho motion for judgment to tho Court of Appeal for argument and determination at the next sitting thereof; the question of costs on tho order being reserved. —Stalker v. Finlayson.— David William Stalker, of Invercargill, v. Sarah Ann Finlayson.—This was a motion to rectify a mistake in a deed of conveyance by "which a right-of-way was described to bo on tho western side of a section in Mornington instead of on the eastern aide. Tho section was purchased by" the defendant from the plaintiff’s father. The defendant denied that any mistake was made. Mr John MacGregor appeared for tho plaintiff, and Mr Brugh for tho defendant. After eVidtnce His Honor said that the plaintiff had not made out a case. If Mr MacGregor showed that plaintiff was the owner of Ids father’s properties, and brought all the parties before the-Court, then be might be entitled to relief. Mr MacGregor elected to take a nonsuit. , The plaintiff was then nonsuited, with costs on the lowest scale.
