MAGISTRATE'S COURT,

(Before H. Y. Widdowson, Esq., S.M.) Judgment by default was given for plaintiffs in the following • cases :—Johnston, Sons, and Co. v. Arthur Hammond (of Palmerston North), books, 10s 6d and costs (6s) j same r. Thomas Bernard Walsh (of Petone), booksj £1 15s and costs (Ss). Whose Furniture?—Wm. Pickworlh (Air Tonkinson) v. Annette Pickworth (Mr Hanlon). —Claim, possession of a quantity of furniture valued at £ll6 6», or the value in cash if possession was not possible.—■ Mr Tonkinson said the parties were separated, and in October last an order of the Court was made for the plaintiff to pay 35s a week for defendant's support. At the end of those proceedings counsel had asked the Court to settle the question of the furniture (which plaintiff claimed was his), but the Court suggested separat* proceedings. The position was that plaintiff had allowed the question of possession of tire furniture to remain in abeyance so long as the wife remained in the house where the furniture was. Recently, however, he found that she had left the house and commenced to sell the furniture. What the man now sought was that the amount for which she had sold the furniture should be set off against the Court’s order. That could not be done in these proceedings, so the demand at present was bir the furniture or its value.—Without hearing more than the statement of plaintiff the Magistrate heM that there was not sufficient evidence that a legal “demand ” for the furniture had been made. Plaintiff was non-suited, with costs (£S 16 s).
