[Per United Press Association'.! AUCKLAND. August 5. The tenants of the Savoy Cafe, in Queen street, were the defendants in a claim i r -r £7O rent heard by Mr Kettle. S.M. Th-i case aroso out of the action of the he-ilth authorities, who ordered the premises to bo closed on the ground of insanitation and to be made rat proof. The business was not resumed. The premises were occupied under a lease, and the plaintiffs claimed seven weeks' rent. Counsel for the defence contended that where the statute compelled a breach of contract i the parties were discharged from further performance. The Magistrate held that | the defendants were liable, and gave jud.gI ment accordingly. GREY MOUTH. 5. The elocutionary competitions concluded Last night. Trinity Anglican Institute were first with 3,693 points. St. Columbia Catholic second with 5.552 point;-, and Methodist third with 2.G07 points WELLINGTON*, August 5. William Sellar Johnston, a wharf laborer, was fined £5 in the Maoris'rate's Court to-day for stealing a rare of whisky from the wharf. It was stated that the accused was under the influence of liquor at the time. The tender of Campbell and Burke. Wellington, at £l6,soo,'has been accepted for the erection of the Public. Trust office at Auckland. NAPIER, August 5. An outbreak of fire occurred in_ the heart of the town at 11 o'clock last night, conrmoacing in the tailoring workshop cf Mr D. Evans, over Mr F. W. Collins's jeweller's shop. The flames obtained a good hold, but the brigade succeeded in confining them to one room, which was .gutted. Mr C.'cllins's stock suffered severely by water. Insurances :—Building (owner Mr H. Triogs), £6OO in the' Standard Office: Mr Coliins's stock, £l5O in the United and £2OO in the Phamix ; Mr Evans, £SO. OAMARC. AuvpMi 5. William Allen, a cleric in tho employ of the Westport Coal Company, pleaded guilty to the theft of £2B, the property of his employers, and was committed to the Supreme Court for sentence.
