The premises were occupied under a lease, and the plaintiffs claimed seven weeks' rent. Counsel for the defence contended that where the statute compelled a breach of contract i the parties were discharged from further performance. William Sellar Johnston, a wharf laborer, was fined £5 in the Maoris'rate's Court to-day for stealing a rare of whisky from the wharf. Trust office at Auckland. NAPIER, August 5. An outbreak of fire occurred in_ the heart of the town at 11 o'clock last night, conrmoacing in the tailoring workshop cf Mr D. Evans, over Mr F. W. Collins's jeweller's shop. The flames obtained a good hold, but the brigade succeeded in confining them to one room, which was .gutted. Mr C.'cllins's stock suffered severely by water.
