COMPENSATION COURT.

LAING AND DOTTING v. THE CORPORATION.

The bearing of these cases (which, were taken together) was concluded to-day before Mr Justice Oooper and Messrs J. F. Woodhouse and T. Chalmers (assessors).

Messrs Laing and Mondy (as executors of the will of the late Francis Gregory Laing) claimed £6OO for the loss of land taken for the widening oP the Main South Dunedin road for tramway purposes, and also for £2OO, the injurious effect caused to adjoining lands belonging to the claimants. John Samuel Rotting claimed £7OO compensation for (a) loss of rents; (b) loss of trade by disturbance; and (c) expenses of removal, advertising, etc. Mr A. S. Adams appeared fort Rotting, Mr Stephens for Laing, and Mr W. C. MacGregor for the Corporation. Counsel addressed the Court this, morning, and at about 1 p.m. the Court gave its award.

In Laing's case His Honor said: “Award in. full of ali matters, £490. We determine that the rent which shall cease to bo payable in respect of the lease of the said land shall bo .£32 per year, dating from tho date of tho proclamation taking the land. The rent payable from that date by tho lessee to the lessor shall be £2O per year. We award that the respondents pay the claimant tho sum of £Bl 7s 6d. and in addition to such sum of £Bl 7s 6d court fees and witnesses’ expenses to be ascertained by the registrar 1 fix the assessors’ fees at tire sum of £lB 7s 6d for each assessor, and direct each party to pay his own assessor.” Dealing with Rotting’s case, His Honor wenV on : “ We, award to the claimant in full of all claims the sum of £525 in full settlement. We assess the sum of £Bl 7s 6d for costs, and in addition to such sum of £Bl 7s 6d court fees and witnesses’ expenses, to be ascertained by the registrar, and order the respondents to pay their costs to the claimant. I fix the assessors’ fees at the sum of £lB 7s 6d for each assessor, and direct each party to pay his own assessor.”
