The Compensation Court ease of Henry Bfcey v. the Corporation of Dunedan, a claim of £2,100 for laud 'injuriously affected by the waterworks extension, Boheme, came to an and to-day. The main facte were the subject, of evidence and argument in May last, Mr Sim appearing for the claimant, and Messrs Solomon ana W. C. MaeOregor for the Corporation, and on the Ist August Mr Justice Williams delivered judgment on the legal question of riparian rights as siffectinc water power, holding that the Maori Hill Borough Council hod no ripaiTan rights in. respect to the road which runs past the Leith, because there is no contact between their property and tie flow of the stream. The case was then adjourned to a convenient day for the Court to dismiss the award. hj« Honor and the- assessor* (Mr C S. Reeves for the claimant and Mr W. L. Simpson for the Corporation) met this morning, and at noon announced their decision.. His Honor said that the judgment of the Court was that the sum of £560 be paid to the claimant in full of all demands. There would be no costs to be paid on either side. The assessors' fees were fixed at four guineas a day for two days. These,' of course, would be paid by the parties. We attach a. table showing to date the various claims 'upon the Orty Corporation for land taken, water rights, etc, in connection with the extension of the water supply, and the awards given. The cases mentioned are only those in which awards have been made by the Compensation Court, the list therefore not including Jane Ann Williams's claim, which was settled out of court, nor the hali-doßen or so claims that have been adjusted privately.
