At 5.30 a.ro. on the 25tb Constable Leece found the men carrying away the potatoes in bags. He (Mr Hanlon) submitted that it was a typical case for the exercise of the power conferred by section 61 of the Indictable Offences Summary Jurisdiction Act—the power, namely, to treat it as a trivial case and dismiss it after admonition—as preferable to recording a conviction, and thereby branding the accused as felons. —His Worship inquired as to the character of (he accused, and finding from the police that there was nothing known against their honesty, decided that if by Monday they paid the damage and the costa (25s 2d in all) the case would be dismissed.
