RESIDENT MAGISTRATE’S COURT.
Tncs Day. (Before A. C. Strode, Esq., R.M.) Civil Cases. Leary (trustee in bankruptcy for Green) v. Stavely (captain of the Naval Brigade).— L 7 12s Id. Mr M ‘Keay for the plaintiff. This was a claim for balance due for work and labor done, which was refused payment, on the ground that the contract was not completed, some slides included in the contract not having been made. Mr Biggery, boat-builder, estimated the value of the work not dono was about L 3 12s.—For the defence, Alexander Grant was called, but could give no evidence beyond the terms of the contract. Judgment for the plaintiff, L 4 Cs Id, with costs. Front v. Head.—los, the value of a second-hand axle. It appeared that the plaintiff bought and paid for an axle which, not suiting, he wished to return ; but as on examination the box was found broken, the defendant refused to receive it or return the money. Judgment for the defendant.
