The Court of Criminal Appeal quashed the conviction of Gerald Francis Wharton, who has been released.

On a charge of participating in the Irish Republican Army terrorist plot Wharton was sentenced on April 3 to ten years' penal servitude. The Judge said that Wharton was a member of a gang which murdered British officert and others up to 1922. He was the worst and most dangerous of the accused. He fought against two Irish Governments and tried in vain to tunnel his way from prison. He was released in 1924 and received a pension from the Irish Government.
