MAGISTRATE UPHELD
DAMAGES FOR ACCIDENT
The awarding of £98 special damages and £10 general damages by Mr. A. M. Goulding, S.M., in the Magistrate's Court on February 7, to James Robert Barber, a waterside worker, who was injured in a collision between a motorcycle and a motor-car at the junction of Riddiford Street and Constable Street on September 5 last, was upheld in the Supreme Court yesterday afternoon by Mr. Justice Blair.
Leonard Maxwell Humphries, a merchant, who was the defendant in the Magistrate's Court, appealed against the judgment of the Magistrate, being represented by Mr. W. D. Goodwin. Mr. R. Hardie Boys appeared for the respondent.
The Magistrate, who awarded the full amount of the special damages and £10 of the £50 general damages claimed, found that Humphries, who was driving the car, had been negligent in swinging as if he had intended
to go south before he headed for the • western side of Riddiford Street, and negligent in not indicating his intention to stop.
His Honour dismissed the appeal
