(By Telegraph—Press Association.)
BLENHEIM, This Day.
"In the circumstances, it is difficult to see how the driver of the truck can be held to .be; accountable for the collision," said his Honour Mr. Justice Northcroft, when referring to the Grand Jury this morning a case against Noel Ernest Sinclair .Rose, of Blenheim, farmer, charged with negligently driving a motor vehicle, thereby causing bodily injury." .' . ... . ; ' The case, which was the only indictable charge for'the Grand Jury, arose out of an accident, at Rapaura when a girl named Ivory, who, ran from behind a school bus, was knocked down by Rose's truck.' • ..... "Frankly, I find some difficulty in understanding why this man has been charged at all, unless the distance travelled after the collision indicates negligence through defective brakes or negligence in controlling the truck after the collision," the Judge added. This, however, he indicated to be entirely irrelevant. .. The Grand Jury returned "no bill."
The Court is engaged on ;a retrial of Leonard Alma Turner, of Pelorus, farmer, on a charge of cattle stealing, on which, a... jury disagreed last session, • . "
